1. AGREEMENT TO THESE TERMS

These Terms and Conditions ("Terms") govern your purchase of products and services from Best Burn Firewood LLC ("Best Burn Firewood," "we," "us," or "our"), a Wisconsin limited liability company located at 19000 W Lincoln Avenue, New Berlin, WI 53146.

These Terms apply to every order placed with us, whether placed through our website, by phone, by email, or in person at our yard. By placing an order, you agree to these Terms.

Our Return and Shipping Policy and Privacy Policy are incorporated into these Terms by reference. Where a plain-language summary on another page differs from these Terms, these Terms govern.

If you do not agree with these Terms, please do not place an order.

2. PRODUCTS AND SPECIFICATIONS

We manufacture and sell kiln-dried firewood, firewood bundles, kindling, firewood racks, and related products.

Kiln drying and certification. Our firewood is processed in-house in commercial kilns at 265°F and dried to 15% moisture. We are certified by the United States Department of Agriculture and the Wisconsin Department of Agriculture, Trade and Consumer Protection.

Species variability. Firewood is a natural product. Individual pieces vary in size, shape, weight, bark coverage, and appearance. Our Mixed Hardwood product is a screened blend whose composition rotates by batch depending on our supply, and no specific species mix is guaranteed. Photographs on our website are representative and are not a guarantee of the exact appearance of any particular load.

Moisture content. Firewood is dried to 15% moisture at the time it leaves our facility. Moisture content can rise after delivery if firewood is stored uncovered, on bare ground, or in direct contact with moisture. We are not responsible for changes in moisture content that occur after delivery.

3. MEASUREMENT AND QUANTITY

Firewood is sold by volume, in units of measure defined by Wisconsin law. Methods of sale for firewood in Wisconsin are set by the Wisconsin Department of Agriculture, Trade and Consumer Protection under Wisconsin Administrative Code ch. ATCP 91, which provides that firewood in quantities greater than 4 cubic feet is sold by weight, by the cord or a fraction of a cord, or by the face cord where the measure is qualified by a statement of the length of the pieces of wood in the face cord.

The following definitions apply to all orders and follow those set out in ATCP 91:

  • Cord: the amount of firewood that, when ranked and well stowed, occupies a space of 128 cubic feet, or a pile four feet by eight feet by four feet.
  • Face cord: an amount of firewood composed of pieces of uniform length of less than four feet which, when ranked and well stowed, compose a pile eight feet wide and four feet high. Our standard piece length is 16 inches, so a face cord from Best Burn Firewood is a 16 inch face cord, equal to one third of a cord.
  • Half cord: one half of a cord.
  • Half face cord: one half of a 16 inch face cord, equal to one sixth of a cord.

We do not sell by the rick, the truckload, the pile, or any other unqualified unit, because those are not defined units of measure under Wisconsin law.

Loose measurement. Because firewood is delivered loose rather than ranked and stowed, loose-thrown wood occupies approximately 40% more volume than the same quantity stacked. Our delivery trucks are measured accordingly, and a full cord is loaded to approximately 180 cubic feet loose so that it measures a true 128 cubic foot cord once ranked and well stowed. A delivered load will therefore look larger than 128 cubic feet before it is stacked. This is expected and is how the quantity is guaranteed.

Delivery ticket. As required under ATCP 91, we provide a delivery ticket or invoice for each bulk firewood delivery stating our name and address, the date of delivery, the quantity of firewood delivered, and the price.

Bundles. Individual bundles contain approximately 0.75 cubic feet of wood, typically 7 to 8 splits cut to 16 inches. A pallet contains 78 bundles.

4. ORDERS, PRICING, AND PAYMENT

Order acceptance. Your order is an offer to purchase. We accept your order when we confirm it by phone or email and schedule your delivery or pickup. We reserve the right to refuse or cancel any order.

Pricing. Prices are listed on our website and are subject to change without notice. The price that applies to your order is the price confirmed at the time we accept it.

Errors. We make every effort to keep pricing and product information accurate. In the event of a pricing or description error, we reserve the right to correct the error and to cancel or decline any order placed based on incorrect information, including after an order has been submitted. If we cancel an order for this reason and payment has been taken, we will issue a full refund.

Payment. We accept major credit and debit cards, PayPal, and digital wallets through our online checkout, and we accept cash and check for in-person transactions. Online payments are processed by our third-party payment processor. We do not store full payment card numbers.

Sales tax. Applicable Wisconsin sales tax is calculated and added at checkout where required by law.

Gift cards. Gift cards are issued electronically, do not expire, and are not redeemable for cash except where required by law.

5. DELIVERY

Delivery area. We deliver throughout southeastern Wisconsin. Delivery availability and fees are determined by ZIP code and are calculated at checkout. Deliveries to the Chicago area and northern Illinois are handled by our separate Illinois operation.

Scheduling. After you place an order, we will contact you by phone or email to schedule delivery. Typical delivery is within 1 to 3 business days of order confirmation. Delivery windows are estimates, not guarantees. Delivery times may be longer during periods of high seasonal demand, and may be delayed by weather, road conditions, equipment issues, or other circumstances outside our control. We are not liable for losses arising from a delayed delivery.

Site access. You are responsible for ensuring that the delivery location is accessible to a loaded delivery truck. This includes adequate driveway width, adequate overhead clearance, an unobstructed approach, and ground conditions capable of supporting a heavy vehicle. You are responsible for informing us in advance of any access limitation, including septic systems, drain fields, sprinkler systems, underground utilities, culverts, private bridges, retaining walls, weight-restricted surfaces, or gate and easement restrictions.

Property risk. Delivery vehicles are heavy. Driving on driveways, lawns, and other surfaces carries an inherent risk of surface marking, rutting, cracking, or settling, particularly when ground is soft, wet, or frozen. By requesting delivery to a specific location on your property, you accept that risk.

We take reasonable care during every delivery. We are not responsible for damage to driveways, lawns, landscaping, irrigation systems, septic components, underground utilities, or other property conditions that you did not disclose to us in advance. Where damage results from our negligence, our liability is limited as described in Section 12.

If you have concerns about the condition of your driveway or grounds, tell us when you schedule, and we will place the load at the curb or another location you specify.

Placement. Unless you have purchased stacking service, firewood is delivered loose and dumped in a single pile at the location you have designated, provided our driver determines that location is safe and accessible.

Delivery instructions and driver discretion. We do not require you to be present at delivery, but we do require clear placement instructions in advance. Our driver has final discretion over placement and over whether a delivery can be completed safely.

If, in the driver's judgment, your instructions are unclear, unsafe, or likely to create a risk to your property, our vehicle or equipment, neighboring property, city or county streets, public land, or any person, the driver may place the load in the nearest location he determines to be safe, or may decline to complete the delivery.

Where we deliver to an unattended property based on your instructions, delivery is deemed complete upon placement. If a delivery is declined for safety reasons, we will contact you to reschedule or to arrange an alternative, and any applicable charges will be handled as described in Section 7.

Stacking service. Stacking is available for an additional fee and must be purchased in advance. Stacking is performed at a location you designate that is reasonably accessible from the delivery point.

Bundles. Individual bundles are available for pickup only at our New Berlin yard. Bundle delivery is available by the pallet through our pallet product, subject to the delivery terms above and to our Pallet Delivery Terms.

6. PICKUP

Pickup at our yard at 19000 W Lincoln Avenue, New Berlin, WI 53146 is free of charge during posted business hours.

You are responsible for bringing a vehicle and trailer adequate for the quantity purchased, for safely securing your load, and for compliance with all applicable laws regarding load securement and vehicle weight limits. We may decline to load a vehicle that we believe is unsuitable or unsafe for the quantity ordered.

7. RETURNS, REFUNDS, AND CANCELLATIONS

Returns and refunds. Because firewood is a bulk natural product, refunds and returns are not provided after purchase unless a proven issue arises with the product or service. The circumstances under which we will investigate and remedy an issue are described in full in our Return and Shipping Policy, which forms part of these Terms.

Cancellations. Orders may be cancelled without charge at any time before the load has been prepared for delivery. Once a delivery has been loaded or a driver has been dispatched, a cancellation may be subject to a charge covering our costs. To cancel or change an order, contact us as soon as possible at (262) 746-7416 or sales@bestburnfirewood.com.

Changes. Requests to change quantity, species, or delivery address are subject to availability and may affect pricing and scheduling.

8. FIREWOOD TRANSPORT AND QUARANTINE

Moving firewood can spread invasive forest pests. Our firewood is USDA and WDATCP certified heat-treated under HT# 2019086, which permits transport in accordance with applicable regulations. You remain responsible for complying with any state, federal, or campground rules that apply to transporting or burning firewood at your destination, including any rules that apply to travel across state lines or into quarantine areas.

9. SAFE USE, STORAGE, AND ASSUMPTION OF RISK

Firewood is sold for use as fuel. You are responsible for safe handling, storage, and burning.

  • Store firewood off the ground, covered on top, and open on the sides for airflow.
  • Follow the manufacturer's instructions and all applicable codes for your fireplace, wood stove, insert, fire pit, smoker, or pizza oven.
  • Have chimneys and flues inspected and cleaned regularly by a qualified professional.
  • Never leave a fire unattended, and keep fires a safe distance from structures and combustible materials.
  • Firewood is heavy. Use appropriate care and equipment when moving or stacking it.

Kiln drying and creosote. Creosote is the tar-like residue that builds up inside a chimney or flue when wood burns incompletely, and creosote buildup is the leading cause of chimney fires. Wet or unseasoned wood burns cooler and smokier because energy is spent boiling off water instead of producing heat, which accelerates creosote formation. Kiln drying to 15% moisture removes that water before the wood reaches you, so it lights faster, burns hotter and cleaner, and produces substantially less creosote than green, wet, or partially seasoned firewood.

Burning kiln-dried firewood reduces the risk of creosote buildup. It does not eliminate it. Creosote accumulation also depends on how your appliance is operated, how the air supply is set, flue temperature, chimney design and condition, draft, how the wood is stored after delivery, and how often the system is cleaned. No firewood, however dry, removes the need for regular professional chimney inspection and cleaning.

Disclaimer. We are not responsible for injury, fire, smoke damage, chimney fire, creosote accumulation, carbon monoxide exposure, property damage, or other loss resulting from the handling, storage, or burning of firewood, or from the condition, installation, maintenance, cleaning, or operation of any chimney, flue, fireplace, stove, insert, fire pit, smoker, oven, or other appliance in which our products are burned.

Firewood racks and other equipment we sell are manufactured by third parties. Any warranty on those products is provided by the manufacturer, not by us. Follow the manufacturer's weight limits and assembly instructions.

10. COMMERCIAL AND WHOLESALE ORDERS

Wholesale, retail distribution, restaurant, and other commercial accounts may be governed by a separate written agreement, purchase order terms, or vendor agreement. Where a signed agreement exists between us and a commercial customer, that agreement controls to the extent it conflicts with these Terms.

11. INTELLECTUAL PROPERTY

All content on our website, including text, photographs, graphics, logos, product descriptions, guides, research studies, and page design, is owned by Best Burn Firewood LLC or licensed to us and is protected by copyright and trademark law. You may not reproduce, republish, or distribute our content for commercial purposes without our prior written permission.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by Wisconsin law:

Our total liability arising out of or relating to any order, product, or these Terms will not exceed the amount you paid for the order giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, or property damage, arising out of or relating to your purchase or use of our products, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Best Burn Firewood LLC, its members, employees, and contractors from any claim, loss, liability, or expense arising out of your breach of these Terms, your misuse of our products, or your failure to disclose a site condition that affects safe delivery.

14. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or any order will be brought exclusively in the state or federal courts located in Waukesha County, Wisconsin, and you consent to the jurisdiction of those courts.

Before filing any claim, you agree to contact us first at sales@bestburnfirewood.com so that we have an opportunity to resolve the matter directly. Most issues are resolved with a phone call.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. The version in effect at the time you place an order governs that order. The "Last updated" date at the top of this page indicates when these Terms were last revised.

16. SEVERABILITY

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
